Overview of Federal Child Pornography Sentencing

Between 2021 and 2025, the United States Sentencing Commission (USSC) tracked outcomes in child pornography cases nationwide. The average prison sentence for federal child pornography offenses was 115 months, or just over ten years. Nearly all defendants (99.5%) received a prison sentence, and 99% were also ordered to serve a term of supervised release after completing their incarceration. Additionally, 68% of offenders were ordered to pay financial restitution directly to their victims.

In terms of demographics, the average offender was 41 years old, with 71.2% being white and nearly all (99.1%) being men.

Certain areas of the country prosecute far more of these cases than others. For example, the Middle District of Florida recorded the highest volume in the nation, with 71 sentences in 2024 alone. The Southern District of Texas followed with 58 cases, closely trailed by the Eastern District of Missouri with 55. The Western District of Missouri reported 54 cases, and the Southern District of Florida had 45. All of these figures are considerably higher than the national average of 15 offenders per federal district.

States With the Most Severe Federal Sentences

Despite all states imposing severe penalties, the data show that average prison terms differ substantially across the country.

Between 2021 and 2025, Indiana recorded the longest median sentence for federal child pornography offenses, with offenders receiving a median prison term of 135 months (over 11 years). Alabama followed closely with a median sentence of 134 months, though it’s noteworthy that the state had the highest average sentence length at 159 months. This suggests that several particularly severe sentences contributed to its total of 62 cases.

Tennessee had a median sentence of 121 months, while Wyoming, Iowa, Kansas, Texas, North Carolina, Kentucky, New Mexico, Michigan, Maryland, and Minnesota all reported a median of 120 months. Apart from Wyoming, each of these states tend to impose at least a decade behind bars, exceeding the national average sentence of 115 months.

Additionally, some states prosecuted far more cases than others during these five years. Texas reported the most federal cases, at 699, while Minnesota had only 57 and New Mexico just 37. Although the volume of prosecutions varied considerably, both Minnesota and New Mexico were among the states with the longest average sentences.

Pennsylvania’s Federal Districts

In Pennsylvania, sentence lengths vary by district. Between 2021 and 2025, the average sentence for child pornography cases was 114 months, and the median was 96 months. This translates to approximately 1.7 cases per 100,000 residents based on the state’s population.

The Eastern District was the harshest in the state, with an average sentence of 145 months and a median of 120 months across 70 cases. The Middle District also showed severe sentencing trends, with an average of 132 months and a median of 120 months across 43 cases.

In contrast, the Western District processed the most cases but imposed much lighter sentences. Its 115 cases accounted for roughly half of the state’s total, yet the average sentence there was 88 months, with a median of just 78 months. This sharp decline in sentencing explains why the overall state average appears much lower than those of the Eastern and Middle districts. Consequently, a person facing charges in Philadelphia could serve several years more in prison than someone with similar charges in the western part of the state.
